1. Agreement to Terms

By accessing or using LinksToBook ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use our Service.

Legal Entity: LinksToBook is operated by Dor Tagger (sole proprietor, doing business as Pointline Agency).

These Terms apply to all users, subscribers, and visitors of linkstobook.com and any custom booking pages hosted on our platform.

2. Description of Service

LinksToBook provides a SaaS platform for service businesses to create custom WhatsApp booking links with the following features:

• Custom vanity URLs (e.g., linkstobook.com/yourname)
• WhatsApp integration with pre-filled messages
• Micro-page or instant redirect modes
• Event tracking and analytics (page views, WhatsApp clicks, UTM attribution)
• AI-generated copy and automated provisioning
• Plan-based features including reports, A/B testing, and fallback forms
• Billing lifecycle management

2.1 Human-Driven Services

Important: While LinksToBook uses AI technology for initial copy generation, our service includes significant human involvement to ensure quality:

• Quality Review: All AI-generated copy is reviewed by our team before delivery. Content scoring below our quality threshold (<70/100) receives manual editing and improvement.
• Launch Support: Our team provides personalized setup assistance, answers questions, and ensures your booking page meets your requirements.
• Customer Support: Human support staff respond to billing inquiries, technical issues, and feature requests (response times: 48h Starter, 24h Growth, Priority Premium).
• Copy Updates: Growth and Premium plans include human-assisted copy revisions (2/month for Growth, unlimited for Premium).

The $299 setup fee covers both AI technology and human expertise to deliver a professional, high-quality booking page tailored to your business.

3. Eligibility

To use LinksToBook, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Operate a legitimate service-based business
• Have a valid WhatsApp Business or personal account
• Provide accurate and complete registration information

4. Account Registration and Security

When you sign up for LinksToBook, you agree to:

• Provide accurate business information (name, location, WhatsApp number, services)
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Be responsible for all activity that occurs under your account
• Not share your account access with unauthorized parties

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Pricing and Payment Terms

5.1 Fees

LinksToBook pricing consists of:

• Setup Fee: $299 (one-time, non-recurring) for AI-generated copy, custom page design, WhatsApp integration, tracking setup, and launch support
• Monthly Subscription: Recurring monthly fee based on your chosen plan:
  • Starter: $49/month
  • Growth: $149/month
  • Premium: $299/month

All prices are in USD and exclude applicable taxes (VAT, GST, sales tax), which will be calculated at checkout based on your location.

5.2 Payment Processing

Payments are processed securely through Paddle, our authorized payment processor. By subscribing, you authorize Paddle to charge your selected payment method on a recurring monthly basis.

You are responsible for providing accurate payment information and maintaining a valid payment method.

5.3 Billing Cycle

Subscriptions are billed monthly in advance. Your billing cycle begins on the day you complete payment and renews automatically on the same day each month.

5.4 Payment Failure and Grace Period

If a payment fails:

• Grace Period (7 days): Your service continues at full functionality while we attempt to process payment. You will receive email reminders on days 1, 3, and 7.
• Degraded State (days 8-30): If payment is not resolved, your booking page enters degraded mode:
  • Visitors are redirected instantly to WhatsApp (no micro-page shown)
  • Analytics tracking continues but no reports are sent
• Deactivation (day 31+): After 23 days in degraded state, your link becomes inactive and displays a "Link Inactive" message. You can reactivate by updating your payment method.

5.5 Plan Changes

You may upgrade or downgrade your plan at any time:

• Upgrades: Take effect immediately. You will be charged a prorated amount for the remainder of your billing cycle.
• Downgrades: Take effect at the start of your next billing cycle. If your current usage exceeds the new plan's limits (e.g., number of services or A/B test variants), you must reduce usage before downgrading.

6. Refund Policy

6.1 Setup Fee Refund (14-Day Money-Back Guarantee)

We offer a 14-day money-back guarantee on the setup fee:

• If you are not satisfied with your LinksToBook setup within 14 days of activation, contact us for a full refund of the $299 setup fee.
• Provision Guarantee: If we fail to provision your LinksToBook page within 3 business days of payment, you are eligible for a full refund of the setup fee.
• Refunds are issued by Paddle back to your original payment method (typically 5–10 business days).
• After 14 days, the setup fee is non-refundable.

6.2 Monthly Subscription Refunds

Monthly subscription fees are non-refundable. Subscriptions are month-to-month with no contract. You may cancel anytime in the Paddle customer portal. Cancellation stops future renewals but does not refund the current billing period already started. You retain access until the end of your paid period.

6.3 Billing Support

7. Cancellation and Termination

7.1 Cancellation by You

You may cancel your subscription at any time:

• Contact us or cancel via your Paddle billing portal
• Cancellation takes effect at the end of your current billing period
• Your booking page and analytics will remain active until the end of the paid period
• After cancellation, your page enters degraded mode (instant WhatsApp redirect), then deactivates after 30 days
• You may reactivate at any time by resubscribing

7.2 Termination by LinksToBook

We reserve the right to suspend or terminate your account immediately if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your use of the Service harms other users or our platform
• You provide false or misleading information
• Your payment method is declined and you do not resolve the issue within 30 days

In case of termination for cause, no refunds will be provided.

8. Acceptable Use Policy

You agree NOT to use LinksToBook for:

• Illegal activities or services (e.g., drugs, weapons, trafficking)
• Adult content or sexually explicit services
• Hate speech, harassment, or discriminatory content
• Spam, phishing, or deceptive practices
• Impersonating another business or individual
• Violating WhatsApp's Terms of Service or business policies
• Sending unsolicited messages or bulk WhatsApp spam
• Scraping, data mining, or reverse engineering our platform

Violation of this policy may result in immediate account termination without refund.

9. Intellectual Property

9.1 Your Content

You retain all ownership rights to your business information, logos, images, and content ("Your Content") that you upload to LinksToBook. By using our Service, you grant us a limited, non-exclusive license to host, display, and process Your Content solely for the purpose of providing the Service.

9.2 Our Platform

LinksToBook owns all rights to the platform, software, design, code, branding, and AI-generated copy. You may not:

• Copy, modify, or distribute our software or code
• Reverse engineer or create derivative works
• Remove or alter any proprietary notices
• Use our branding or trademarks without permission

9.3 AI-Generated Content

Copy generated by our AI (headlines, CTAs, service descriptions, FAQs) becomes your property upon delivery. You may edit, modify, or remove this content at any time.

10. Third-Party Services and Disclaimers

10.1 WhatsApp Integration

LinksToBook is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta Platforms, Inc. We provide a third-party service that generates links compatible with WhatsApp's public API (`wa.me` links).

You are responsible for:

• Complying with WhatsApp's Terms of Service and Business Policy
• Maintaining your WhatsApp account in good standing
• Responding to customer inquiries received via WhatsApp

We are not responsible for WhatsApp service outages, account suspensions, or policy changes.

10.2 Payment Processing (Paddle)

Payment processing is handled by Paddle. We do not store your credit card information. Disputes related to charges or payment failures should be directed to Paddle support.

10.3 Form Submissions (Optional)

If you enable the fallback contact form (Growth+ plans), submissions are stored in our secure database and you receive email notifications. We take reasonable measures to protect this data but are not liable for data loss, unauthorized access, or email delivery issues with third-party email services.

11. Service Availability and Uptime

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. LinksToBook may experience downtime due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency repairs or security updates
• Third-party service outages (hosting, DNS, payment processors)
• Force majeure events (natural disasters, cyberattacks, etc.)

We are not liable for lost revenue, missed bookings, or business interruption due to service downtime.

12. Limitation of Liability

To the maximum extent permitted by law:

• LinksToBook is provided "as is" without warranties of any kind (express or implied)
• We do not guarantee specific results, bookings, or revenue from using our Service
• Our total liability for any claim arising from your use of LinksToBook is limited to the amount you paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages (lost profits, data loss, business interruption)

13. Indemnification

You agree to indemnify and hold harmless LinksToBook, its employees, and partners from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your business activities or services promoted via LinksToBook
• Content you upload or display on your booking page
• Your violation of any third-party rights (intellectual property, privacy, etc.)

14. Data and Privacy

Your use of LinksToBook is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using our Service, you agree to our privacy practices.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Significant changes will be communicated via email at least 14 days before taking effect.

Your continued use of LinksToBook after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your Jurisdiction - e.g., State of Delaware, USA / Cyprus], without regard to conflict of law principles.

Any disputes arising from these Terms or your use of LinksToBook shall be resolved through:

• Small Claims Court: Either party may bring a claim in small claims court if it qualifies

You waive the right to participate in class-action lawsuits or class-wide arbitration.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
